You are responsible for:

  • All activity performed through your account
  • Informing us of unauthorized access or suspected security issues

3. Hosting Services

WebfyMediaHosting may provide hosting and infrastructure services including VPS, reseller hosting, Windows hosting, Java hosting, and other hosting solutions.

Available resources may include CPU, RAM, storage, bandwidth, networking, and other infrastructure resources depending on the selected service plan.

Resource limits and service features may vary between plans.


4. Software and Web Development Services

We may provide software development, website development, web application development, and custom technology solutions.

Project requirements, features, timelines, pricing, and deliverables may be defined separately through an order, proposal, quotation, project document, or written agreement.

Work outside the agreed project scope may require additional time or charges.


5. Mobile Application Development

We may provide Android, iOS, and cross-platform mobile application development services.

Customers are responsible for providing accurate project requirements, content, branding materials, credentials, and other information required to complete the project.

Third-party developer accounts, app-store accounts, licenses, APIs, and platform fees may be subject to the terms and charges of the respective third parties.


6. CMS and Managed Services

We may provide CMS management, website maintenance, database management, software updates, configuration, and related managed technology services.

The exact scope of managed services depends on the selected service or project agreement.


7. Acceptable Use Policy

Customers must use our services lawfully and responsibly.

The following activities are prohibited:

  • Malware, viruses, ransomware, or malicious software
  • Phishing or credential theft
  • Fraudulent or deceptive activities
  • Spam or unauthorized bulk messaging
  • Operating unauthorized open mail relays
  • Distributed denial-of-service attacks
  • Unauthorized network attacks or scanning
  • Cryptocurrency mining where prohibited by the applicable service
  • Hosting illegal content
  • Attempting to compromise shared infrastructure
  • Attempting to bypass security controls
  • Hypervisor escape attempts
  • Unauthorized access to other customers, servers, systems, or networks

We may suspend or terminate services when necessary to protect our infrastructure, customers, or third parties.


8. Customer Responsibilities

Customers are responsible for:

  • Their account credentials
  • Content uploaded to their services
  • Applications and software deployed on their servers
  • Maintaining appropriate backups
  • Ensuring their use of the services complies with applicable laws
  • Maintaining the security of applications and credentials under their control

9. Intellectual Property

Customers retain ownership of materials and content that they provide to us, subject to any separate written agreement.

WebfyMediaHosting retains ownership of its own pre-existing software, tools, frameworks, templates, systems, processes, infrastructure, trademarks, and intellectual property unless otherwise agreed in writing.

Ownership and licensing of custom project deliverables may be defined in the applicable project agreement.


10. Third-Party Services and APIs

Our services may integrate with third-party platforms, APIs, software, payment providers, cloud services, app stores, or other external services.

Third-party services are subject to their respective terms, policies, availability, and pricing.

We are not responsible for changes, interruptions, limitations, or failures caused by third-party services.


11. Orders, Payments and Renewals

Hosting services may be billed on a monthly, quarterly, annual, or other applicable billing cycle.

Customers are responsible for paying invoices by the applicable due date.

Project-based software and development services may follow the payment schedule agreed upon in the applicable quotation or project agreement.


12. Refunds and Cancellation

Refund eligibility depends on the service purchased and the applicable refund policy.

Certain services, products, development work, custom projects, setup fees, licenses, domain-related services, or third-party charges may not be eligible for refunds.

Customers may request cancellation according to the applicable service cancellation procedure.


13. Project Scope and Changes

For custom development projects, the agreed scope defines the expected deliverables.

Requests for additional features, major design changes, new integrations, or functionality outside the agreed scope may require additional charges and development time.

Changes to project requirements may also affect the estimated delivery schedule.


14. Service Suspension and Termination

We may suspend or terminate a service when:

  • An invoice remains unpaid
  • The service is used in violation of these Terms
  • The customer violates applicable laws
  • The account creates a security or operational risk
  • Fraudulent or abusive activity is detected
  • Required information is not provided

Customers may cancel services according to the applicable cancellation procedure.


15. Backups and Data Responsibility

Customers are responsible for maintaining appropriate backups of important data, applications, databases, websites, and other content.

Although backup solutions may be offered with certain services, customers should maintain independent backups where appropriate.


16. Service Availability

We aim to provide reliable and secure services. However, uninterrupted availability cannot be guaranteed in every situation.

Service availability may be affected by maintenance, infrastructure failures, network issues, security incidents, third-party services, or circumstances outside our reasonable control.

Specific availability commitments, if applicable, are described in the applicable SLA Agreement.


17. Limitation of Liability

To the maximum extent permitted by applicable law, WebfyMediaHosting will not be responsible for indirect, incidental, special, consequential, or similar damages arising from the use or inability to use our services.

This may include loss of data, revenue, business opportunities, or profits.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.
